CONSIDERANDO\u00a0<\/b>o arrazoado contido no parecer da Assessoria Jur\u00eddica deste Munic\u00edpio;<\/p>\n

 <\/p>\n

CONSIDERANDO<\/b>\u00a0o disposto do Inciso V, artigo 74, da Lei Federal n\u00ba 14.133\/21, de 01 de abril de 2021 e o Decreto Municipal n\u00b0 11, de 24 de mar\u00e7o de 2023, verbis:<\/p>\n

\u201cArt. 74, – \u00c9 inexig\u00edvel a licita\u00e7\u00e3o quando invi\u00e1vel a competi\u00e7\u00e3o, em especial nos casos de:<\/p>\n

V – aquisi\u00e7\u00e3o ou loca\u00e7\u00e3o de im\u00f3vel cujas caracter\u00edsticas de instala\u00e7\u00f5es e de localiza\u00e7\u00e3o tornem necess\u00e1ria sua escolha.\u201d<\/p>\n

 <\/p>\n

CONSIDERANDO\u00a0<\/b>que, para o objeto em tela \u00e9 de exclusividade, n\u00e3o havendo qualquer outra empresa que possa lhe fazer frente, inviabilizando, com isso, qualquer competi\u00e7\u00e3o;<\/p>\n

 <\/p>\n

CONSIDERANDO<\/b>\u00a0haver adequa\u00e7\u00e3o or\u00e7ament\u00e1ria e financeira para custear a despesa, conforme a Lei Or\u00e7ament\u00e1ria em vigor (exerc\u00edcio de 2026), bem como, compatibilidade como o Plano Plurianual (PPA) e a Lei de Diretrizes Or\u00e7ament\u00e1rias (LDO – exerc\u00edcio de 2026) e saldo or\u00e7ament\u00e1rio suficiente conforme atestado pelo Setor de competente.<\/p>\n

RESOLVE<\/b><\/p>\n

Com fundamento no\u00a0Artigo 74, V, da Lei Federal n\u00ba 14.133\/21, CONTRATAR<\/b>, POR MEIO DE INEXIGIBILIDADE DE LICITA\u00c7\u00c3O o seguinte objeto:\u00a0LOCA\u00c7\u00c3O DE IM\u00d3VEL SITUADO NA RUA FERNANDO BARRETO, N\u00ba 1427, LAGOA NOVA – NATAL\/RN, CEP: 59.075-720, DESTINADO A ACOLHER PACIENTES DO MUNIC\u00cdPIO DE LAJES QUE NECESSITAM DESLOCAR-SE \u00c0 CAPITAL PARA TRATAMENTOS M\u00c9DICOS,\u00a0<\/b>em favor da empresa\u00a0MARLUCE MARIA DO NASCIMENTO FERNANDES DE QUEIROZ & CIA LTDA, CNPJ n\u00ba 24.556.522\/0001-32<\/b>, estabelecida \u00e0 Rua Jos\u00e9 Tomaz Ferreira Campos, n\u00ba 195, Candel\u00e1ria \u2013 Natal\/RN, CEP: 59.066-160, que apresentou a melhor proposta para o objeto em tela, no valor global de\u00a0R$ 54.600,00 (cinquenta e quatro mil e seiscentos reais ).<\/b><\/p>\n

 <\/p>\n

A Prefeitura Municipal efetuar\u00e1 o pagamento ap\u00f3s o tr\u00e2mite normal do processo de liquida\u00e7\u00e3o da despesa.<\/p>\n

RATIFICA\u00c7\u00c3O<\/b><\/p>\n

Ante o exposto, tendo em vista os fundamentos apresentados e a regularidade formal do Processo Administrativo n\u00b0 67\/02-2026, bem como seu enquadramento legal, RATIFICO o\u00a0TERMO DE INEXIGIBILIDADE DE LICITA\u00c7\u00c3O N\u00ba 23\/2026,\u00a0<\/b>para que este produza seus legais efeitos.<\/p>\n

O PREFEITO MUNICIPAL DE LAJES\/RN<\/b>, no uso das atribui\u00e7\u00f5es que lhe s\u00e3o conferidas pela Lei Org\u00e2nica do Munic\u00edpio,<\/p>\n

CONSIDERANDO<\/b>\u00a0o teor do Of\u00edcio n\u00ba 66\/2026\/EMATER \u2013 GDG\/EMATER \u2013 DIRETORIA-EMATER;<\/p>\n

\n

CONSIDERANDO<\/b>\u00a0o interesse p\u00fablico na coopera\u00e7\u00e3o entre entes e institui\u00e7\u00f5es, especialmente no fortalecimento das pol\u00edticas p\u00fablicas voltadas ao desenvolvimento rural;<\/p>\n

RESOLVE:<\/b><\/p>\n

Art. 1\u00ba<\/b>\u00a0Fica autorizada a cess\u00e3o da servidora\u00a0DACI DO CARMO RODRIGUES DE MACEDO<\/b>, inscrita no CPF n\u00ba ##7.407.404-## e matr\u00edcula funcional n\u00ba 0003964, pertencente ao quadro de servidores efetivos do Munic\u00edpio de Lajes\/RN, para atuar junto ao EMATER\/RN.<\/p>\n

\n

Art. 2\u00ba<\/b>\u00a0A cess\u00e3o de que trata esta Portaria ter\u00e1 vig\u00eancia at\u00e9 31 de dezembro de 2028, observada a legisla\u00e7\u00e3o vigente e mediante os tr\u00e2mites administrativos cab\u00edveis, com \u00f4nus para o \u00f3rg\u00e3o cedente.<\/p>\n

\n

Art. 3\u00ba<\/b>\u00a0Caber\u00e1 ao \u00f3rg\u00e3o cession\u00e1rio o controle de frequ\u00eancia da servidora, bem como o acompanhamento de suas atividades funcionais durante o per\u00edodo da cess\u00e3o.<\/p>\n

Art. 4\u00ba<\/b>\u00a0Esta Portaria entra em vigor na data de sua publica\u00e7\u00e3o.<\/p>\n

O PREFEITO CONSTITUCIONAL DO MUNICIPIO DE LAJES, ESTADO DO RIO GRANDE DO NORTE<\/b>, no uso de suas atribui\u00e7\u00f5es que lhes s\u00e3o conferidas pela Lei Org\u00e2nica Municipal, e de conformidade com o Decreto N\u00ba.004, de 29 de janeiro de 2025;<\/p>\n

CONSIDERANDO\u00a0<\/b>o disposto na Lei Municipal n\u00ba 1007 de 08 de janeiro de 2025.<\/p>\n

CONSIDERANDO\u00a0<\/b>o disposto na Lei Complementar Municipal n\u00ba 001, de 25 de setembro de 1997.<\/p>\n

RESOLVE:<\/b><\/p>\n

Art. 1\u00ba<\/b>\u00a0Conceder di\u00e1rias aos servidores abaixo relacionados, para custeio de despesas com deslocamento, alimenta\u00e7\u00e3o e demais gastos necess\u00e1rios ao desempenho de atividades institucionais:<\/p>\n

I \u2013\u00a0SIDKLEY SALVADOR MENDES<\/b>, Diretor Executivo do Departamento de Tr\u00e2nsito, recebendo\u00a002 (duas) meias di\u00e1rias<\/b>\u00a0no valor total de\u00a0R$ 150,00<\/b>\u00a0(Cento e cinquenta reais);<\/p>\n

II \u2013\u00a0FLORIANO NUNES DE OLIVEIRA,<\/b>\u00a0Coordenador T\u00e9cnico de Tr\u00e2nsito, recebendo\u00a002 (duas) meias di\u00e1rias<\/b>\u00a0no valor total de\u00a0R$ 150,00<\/b>\u00a0(Cento e cinquenta reais);<\/p>\n

 <\/p>\n

Art. 2\u00ba<\/b>\u00a0As di\u00e1rias destinam-se \u00e0 realiza\u00e7\u00e3o de visita t\u00e9cnica ao Departamento de Tr\u00e2nsito do Munic\u00edpio de Pau dos Ferros\/RN, o qual j\u00e1 se encontra devidamente integrado \u00e0s normas e especifica\u00e7\u00f5es legais vigentes. A referida visita tem como finalidade a capacita\u00e7\u00e3o dos servidores municipais, visando \u00e0 implementa\u00e7\u00e3o de pr\u00e1ticas adequadas no Munic\u00edpio de Lajes\/RN, com o objetivo de promover a integra\u00e7\u00e3o e adequa\u00e7\u00e3o do Departamento Municipal de Tr\u00e2nsito \u00e0s exig\u00eancias legais, em raz\u00e3o do afastamento da sede do Munic\u00edpio, para custeio de despesas com deslocamento, alimenta\u00e7\u00e3o e hospedagem, no interesse da Administra\u00e7\u00e3o P\u00fablica Municipal.<\/p>\n

Art. 3\u00ba<\/b>\u00a0Esta Portaria entra em vigor na data de sua publica\u00e7\u00e3o.<\/p>\n

SEGUNDO TERMO ADITIVO AO CONTRATO ADMINISTRATIVO N\u00ba 22\/2025, QUE FAZEM ENTRE SI O MUNIC\u00cdPIO DE LAJES\/RN, E A EMPRESA JMT SERVI\u00c7OS E LOCA\u00c7\u00c3O DE M\u00c3O DE OBRA LTDA.<\/p>\n

Pelo presente instrumento contratual onde de um lado\u00a0O MUNIC\u00cdPIO DE LAJES\/RN<\/b>, atrav\u00e9s da demais secretarias, pessoa jur\u00eddica de direito p\u00fablico, com sede administrativa \u00e0 Rua Ramiro Pereira da Silva, n\u00ba 17, centro \u2013 CEP: 59.535-000, devidamente inscrita no CNPJ\/MF, sob o n\u00ba. 08.113.466\/0001-05, neste ato representado, na forma de sua Lei Org\u00e2nica, pelo Prefeito Municipal o Sr.\u00a0FELIPE FERREIRA DE MENEZES ARA\u00daJO<\/b>, doravante denominada\u00a0CONTRATANTE<\/b>, e a empresa\u00a0JMT SERVICOS DE LOCACAO DE MAO DE OBRA LTDA<\/b>, inscrito(a) no CNPJ\/MF sob o n\u00ba 07.442.731\/0001-36, sediado(a) Rua dos Potiguares \u2013 N\u00ba 2300 \u2013 Nossa Senhora de Nazar\u00e9 \u2013 Natal\/RN \u2013 CEP: 59.062-280, neste ato representado por\u00a0JONAS ALVES DA SILVA<\/b>\u00a0inscrito no CPF n\u00ba XXX.755.XXX-53, que exerce a fun\u00e7\u00e3o de Diretor, conforme consta no ato constitutivo da empresa, doravante denominada\u00a0CONTRATADA,<\/b>\u00a0tendo em vista o que consta no Processo n\u00ba 53\/02\/2026, e em observ\u00e2ncia \u00e0s disposi\u00e7\u00f5es da Lei n\u00ba 14.133, de 1\u00ba de abril de 2021, e demais legisla\u00e7\u00e3o aplic\u00e1vel, resolvem celebrar o presente\u00a0Termo Aditivo de prorroga\u00e7\u00e3o do prazo de vig\u00eancia contratual<\/b>, mediante as cl\u00e1usulas e condi\u00e7\u00f5es a seguir enunciadas.<\/p>\n

CL\u00c1USULA PRIMEIRA \u2013 OBJETO<\/b><\/p>\n

 <\/p>\n

O presente termo aditivo tem por objeto a prorroga\u00e7\u00e3o do prazo de vig\u00eancia do Contrato n\u00ba 22\/2025, por mais 12 meses, a partir de\u00a025\/03\/2026 at\u00e9 24\/03\/2027<\/b>, para dar continuidade a CONTRATA\u00c7\u00c3O DE EMPRESA, PARA PRESTA\u00c7\u00c3O DE SERVI\u00c7O DE M\u00c3O DE OBRA, podendo ser prorrogado sucessivamente, respeitada a vig\u00eancia m\u00e1xima decenal, na forma do artigo 107 da Lei n\u00ba 14.133, de 2021.<\/p>\n

 <\/p>\n

CL\u00c1USULA SEGUNDA \u2013 PRE\u00c7O<\/b><\/p>\n

2.1. O CONTRATANTE pagar\u00e1 ao CONTRATADO pela execu\u00e7\u00e3o do objeto deste Contrato o valor mensal de R$ R$ 608.890,49 (Seiscentos e oito mil, oitocentos e noventa reais e quarenta e nove centavos), totalizando o valor global de R$ 7.306.685,88 (sete milh\u00f5es, trezentos e seis mil, seiscentos e oitenta e cinco reais e oitenta e oito centavos).<\/p>\n

2.2. O valor acima \u00e9 meramente estimativo, de forma que os pagamentos devidos ao CONTRATADO depender\u00e3o dos quantitativos efetivamente prestados.<\/p>\n

O MUNIC\u00cdPIO DE LAJES\/RN<\/b>, pessoa jur\u00eddica de direito p\u00fablico, com sede administrativa \u00e0 Rua Ramiro Pereira da Silva, n\u00ba 17, centro \u2013 CEP: 59.535-000, devidamente inscrita no CNPJ\/MF, sob o n\u00ba. 08.113.466\/0001-05, neste ato representado, na forma de sua Lei Org\u00e2nica, pelo Prefeito Municipal o Sr.\u00a0FELIPE FERREIRA DE MENEZES ARA\u00daJO<\/b>, brasileiro, residente \u00e0 Rua Vereador Mael Querino, n\u00ba 88 centro, Lajes\/RN \u2013 CEP: 59.535-000, portador do CPF n\u00ba XXX.085.XXX-27 e RG n\u00ba XXX.842.XXX \u2013 SSP\/RN, no uso de suas atribui\u00e7\u00f5es legais,<\/p>\n

RESOLVE:<\/b><\/p>\n

Com fundamento no art. 136, inciso I, da Lei n\u00ba 14.133\/2021, apostilar o Contrato n\u00ba 17\/2025, firmado com a\u00a0COOPERATIVA DE TRABALHO DOS PROFISSIONAIS DA EDUCA\u00c7\u00c3O DO ESTADO DO RN \u2013 COOPEDU<\/b>, inscrita no CNPJ n\u00ba 35.537.126\/0001-84, sediado(a) Rua Projetada, n\u00ba 01, Loteamento Mirante do Trairi, Centro, Monte Alegre\/RN \u2013 CEP: 59.182-000, para fins de recomposi\u00e7\u00e3o do equil\u00edbrio econ\u00f4mico-financeiro, mediante repactua\u00e7\u00e3o, conforme as condi\u00e7\u00f5es a seguir:<\/b><\/p>\n

CL\u00c1USULA PRIMEIRA – DO OBJETO<\/p>\n

 <\/p>\n

O presente Termo de Apostilamento tem por objeto a\u00a0repactua\u00e7\u00e3o dos valores contratuais<\/b>, visando \u00e0 recomposi\u00e7\u00e3o do equil\u00edbrio econ\u00f4mico-financeiro do Contrato n\u00ba 17\/2025, em raz\u00e3o do aumento do sal\u00e1rio m\u00ednimo nacional, conforme Decreto Federal n\u00ba 12.797\/2025.<\/p>\n

 <\/p>\n

CL\u00c1USULA SEGUNDA \u2013 DA JUSTIFICATIVA<\/p>\n

 <\/p>\n

2.1. A presente repactua\u00e7\u00e3o decorre da eleva\u00e7\u00e3o do sal\u00e1rio m\u00ednimo nacional, que passou de R$ 1.518,00 para R$ 1.621,00 a partir de 1\u00ba de janeiro de 2026, impactando diretamente os custos de m\u00e3o de obra vinculados \u00e0 execu\u00e7\u00e3o contratual.<\/p>\n

2.2. A medida encontra respaldo no art. 6\u00ba, inciso LIX, e art. 135 da Lei n\u00ba 14.133\/2021, bem como no parecer jur\u00eddico constante dos autos.<\/p>\n

 <\/p>\n

CL\u00c1USULA TERCEIRA \u2013 DO VALOR<\/p>\n

 <\/p>\n

3.1. Em raz\u00e3o da repactua\u00e7\u00e3o, o valor do contrato passa de\u00a0R$ 10.144.531,68 (dez milh\u00f5es, cento e quarenta e quatro mil, quinhentos e trinta e um reais e sessenta e oito centavos)<\/b>\u00a0para\u00a0R$ 10.357.078,56 (dez milh\u00f5es, trezentos e cinquenta e sete mil, setenta e oito reais e cinquenta e seis centavos)<\/b>, conforme planilha de custos aprovada pelo setor competente, que passa a integrar o presente apostilamento.<\/p>\n

3.2. A recomposi\u00e7\u00e3o limita-se exclusivamente \u00e0s parcelas afetadas pela varia\u00e7\u00e3o do sal\u00e1rio m\u00ednimo, conforme demonstrado nas planilhas apresentadas e analisadas pela Administra\u00e7\u00e3o.<\/p>\n

CL\u00c1USULA QUARTA \u2013 DO PAGAMENTO E DA DOTA\u00c7\u00c3O OR\u00c7AMENT\u00c1RIA<\/p>\n

4.1. Os pagamentos ser\u00e3o realizados de acordo com a presta\u00e7\u00e3o dos servi\u00e7os descriminados nas Ordens de Servi\u00e7os emitidas pelo respons\u00e1vel desta Prefeitura Municipal.<\/p>\n

JULGAMENTO DE HABILITA\u00c7\u00c3O – DISPENSA DE LICITA\u00c7\u00c3O N\u00b0 06\/2026<\/strong><\/p>\n

<\/div>\n

OBJETO: Contrata\u00e7\u00e3o de empresa para presta\u00e7\u00e3o de servi\u00e7os de assessoria administrativa, visando a gest\u00e3o e monitoramento de programas educacionais junto aos sistemas governamentais (SIMEC e FNDE), bem como o saneamento de pend\u00eancias e a otimiza\u00e7\u00e3o das rotinas operacionais da Secretaria Municipal de Educa\u00e7\u00e3o de Lajes\/RN.<\/p>\n

 <\/p>\n

Ap\u00f3s an\u00e1lise da documenta\u00e7\u00e3o e das condi\u00e7\u00f5es apresentadas, e em observ\u00e2ncia ao disposto no art. 62 e seguintes da Lei n\u00ba 14.133\/21, bem como ao Aviso de Dispensa de Licita\u00e7\u00e3o e seus anexos, procede \u00e0 an\u00e1lise da documenta\u00e7\u00e3o apresentada pelas empresas para fins de habilita\u00e7\u00e3o:<\/p>\n

 <\/p>\n

*A empresa\u00a057.775.341 MARCIO CASTILHO DOS SANTOS<\/b>, inscrita no CNPJ n\u00ba\u00a057.775.341\/0001-56<\/b>, apresentou atividades econ\u00f4micas incompat\u00edveis com o objeto da contrata\u00e7\u00e3o, em desacordo com o\u00a0item 3.1<\/b>\u00a0do Aviso de Dispensa<\/b>, que exige atua\u00e7\u00e3o no ramo pertinente. Ademais, n\u00e3o apresentou a Certid\u00e3o de Regularidade do FGTS (CRF), exigida para comprova\u00e7\u00e3o de regularidade fiscal junto \u00e0 Caixa Econ\u00f4mica Federal, conforme\u00a0item 9.14<\/b>\u00a0. Verificou-se ainda que a Certid\u00e3o Federal foi apresentada em nome do CPF do propriet\u00e1rio, e n\u00e3o no CNPJ da empresa, contrariando as exig\u00eancias do instrumento convocat\u00f3rio. Assim, por n\u00e3o atender integralmente \u00e0s exig\u00eancias, e com fundamento nos\u00a0itens 9.1 e 9.1.1<\/b>\u00a0do Aviso de Dispensa, a empresa \u00e9 declarada\u00a0INABILITADA<\/b>\u00a0no presente procedimento;<\/p>\n

 <\/p>\n

*A empresa\u00a0ALFA SERVI\u00c7OS EMPRESARIAIS LTDA<\/b>, inscrita no CNPJ n\u00ba\u00a040.783.433\/0001-85<\/b>, apresentou atividades econ\u00f4micas incompat\u00edveis com o objeto da contrata\u00e7\u00e3o, em desacordo com o\u00a0item 3.1 do Aviso de Dispensa<\/b>, que exige atua\u00e7\u00e3o no ramo pertinente. Ademais, n\u00e3o apresentou documento de identifica\u00e7\u00e3o do respons\u00e1vel legal (RG e CPF), bem como deixou de apresentar a declara\u00e7\u00e3o de que n\u00e3o emprega menor de 18 anos em trabalho noturno, perigoso ou insalubre, nem menor de 16 anos, em desacordo com as exig\u00eancias previstas no\u00a0item 9.14.5 do Termo de Refer\u00eancia<\/b>\u00a0. Assim, por n\u00e3o atender integralmente \u00e0s exig\u00eancias do instrumento convocat\u00f3rio, e com fundamento nos\u00a0itens 9.1 e 9.1.1 do Aviso de Dispensa<\/b>, a empresa \u00e9 declarada\u00a0INABILITADA<\/b>\u00a0no presente procedimento;<\/p>\n

 <\/p>\n

*A empresa\u00a0AGIR CONSULTORIA E ASSESSORIA LTDA<\/b>, CNPJ:\u00a041.922.079\/0001-95<\/b>, apresentou toda a documenta\u00e7\u00e3o exigida, atendendo aos requisitos legais e edital\u00edcios, sendo, portanto, considerada\u00a0HABILITADA<\/b>\u00a0para a contrata\u00e7\u00e3o;<\/p>\n

 <\/p>\n

O julgamento fundamentou-se na\u00a0verifica\u00e7\u00e3o da regularidade jur\u00eddica, fiscal e trabalhista<\/b>\u00a0conforme o Aviso de Dispensa e o termo de refer\u00eancia.<\/p>\n

Ressalta-se que, inicialmente, a an\u00e1lise de habilita\u00e7\u00e3o recaiu sobre a documenta\u00e7\u00e3o apresentada pela primeira empresa classificada no certame, em estrita observ\u00e2ncia \u00e0 ordem de classifica\u00e7\u00e3o estabelecida no procedimento. Diante da inabilita\u00e7\u00e3o da referida empresa, procedeu-se, de forma sucessiva e conforme previsto no Aviso de Dispensa de Licita\u00e7\u00e3o e na Lei n\u00ba 14.133\/2021, \u00e0 convoca\u00e7\u00e3o e an\u00e1lise da documenta\u00e7\u00e3o das empresas subsequentes, respeitando-se rigorosamente a ordem classificat\u00f3ria, o que efetivamente ocorreu no presente caso, at\u00e9 a identifica\u00e7\u00e3o de empresa que atendesse integralmente \u00e0s exig\u00eancias habilitat\u00f3rias.<\/p>\n
