PRIMEIRO TERMO DE APOSTILAMENTO DE ACR\u00c9SCIMO DE DOTA\u00c7\u00c3O OR\u00c7AMENT\u00c1RIA CONCERNENTE AO CONTRATO ADMINISTRATIVO N\u00ba 029\/2023, ENTRE A PREFEITURA MUNICIPAL DE LAJES\/RN E A EMPRESA ATLAS CONSULTORIA E AUDITORIA CONTABIL LTDA<\/b><\/p>\n

 <\/p>\n

Pelo presente instrumento contratual onde de um lado\u00a0O MUNIC\u00cdPIO DE LAJES\/RN<\/b>, pessoa jur\u00eddica de direito p\u00fablico, com sede administrativa \u00e0 Rua Ramiro Pereira da Silva, n\u00ba 17, centro \u2013 CEP: 59.535-000, devidamente inscrita no CNPJ\/MF, sob o n\u00ba. 08.113.466\/0001-05, neste ato representado, na forma de sua Lei Org\u00e2nica, pelo Prefeito Municipal o Sr.\u00a0FELIPE FERREIRA DE MENEZES ARA\u00daJO<\/b>, brasileiro, residente \u00e0 Rua Vereador Mael Querino, n\u00ba 88 centro, Lajes\/RN \u2013 CEP: 59.535-000, portador do CPF n\u00ba 090.085.724-27 e RG n\u00ba 2842134 \u2013 SSP\/RN, de um lado e de outro, a empresa\u00a0ATLAS CONSULTORIA E AUDITORIA CONTABIL LTDA, inscrita no CNPJ sob n\u00ba 41.302.240\/0001-28<\/b>, estabelecida \u00e0 Rua Benedito Santana n\u00b0 149, Regomoleiro, S\u00e3o Gon\u00e7alo do Amarante\/RN \u2013 CEP: 59.298-820, sendo representada pelo Sr. GERSON KLEY DE BRITO DE LIMA, inscrito no CPF n\u00ba 093.723.804-07 e RG n\u00ba 002.365.751 \u2013 ITEP\/RN, resolvem celebrar o Termo de\u00a0APOSTILAMENTO<\/b>\u00a0do Contrato n\u00ba 029\/2023, que se reger\u00e1 pela legisla\u00e7\u00e3o pertinente, Lei Federal n\u00ba 8.666\/93, com as altera\u00e7\u00f5es introduzidas posteriormente e pelas cl\u00e1usulas e condi\u00e7\u00f5es seguintes:<\/p>\n

CL\u00c1USULA PRIMEIRA – DO OBJETO<\/b><\/p>\n

1.1 \u2013 Constitui objeto do presente termo de apostilamento contratual o acr\u00e9scimo de dota\u00e7\u00e3o or\u00e7ament\u00e1ria que far\u00e1 frente \u00e0s despesas do contrato administrativo n\u00ba. 029\/2023, origin\u00e1rio da Inexigibilidade de Licita\u00e7\u00e3o 019\/2023, que versa sobre\u00a0CONTRATA\u00c7\u00c3O DE EMPRESA ESPECIALIZADA EM ASSESSORIA E CONSULTORIA CONT\u00c1BIL PARA EXECU\u00c7\u00c3O DOS SEGUINTES SERVI\u00c7OS: ELABORA\u00c7\u00c3O DO PPA (PLANO PLURIANUAL), LDO (LEI DE DIRETRIZES OR\u00c7AMENT\u00c1RIAS), LOA (LEI OR\u00c7AMENT\u00c1RIA ANUAL); SERVI\u00c7OS DE CONTABILIDADE P\u00daBLICA, FINANCEIRA E OR\u00c7AMENT\u00c1RIA, INTEGRADA COM A FOLHA DE PAGAMENTO DOS SERVIDORES E GERA\u00c7\u00c3O DE RELAT\u00d3RIOS GERAIS; ATENDER O CUMPRIMENTO DAS NORMAS E LEGISLA\u00c7\u00c3O QUE REGEM A CONTABILIDADE P\u00daBLICA, AL\u00c9M DE ELABORA\u00c7\u00c3O DE PE\u00c7AS CONT\u00c1BEIS EXIGIDAS PELOS \u00d3RG\u00c3OS DE CONTROLES: TRIBUNAL DE CONTAS DO ESTADO – TCE\/RN, SECRETARIA DO TESOURO NACIONAL – STN, FUNDO NACIONAL DE SA\u00daDE – FNS, FUNDO NACIONAL DE ASSIST\u00caNCIA SOCIAL – FNAS E O FUNDO NACIONAL DE EDUCA\u00c7\u00c3O – FNDE, BEM COMO AS NOVAS NORMAS BRASILEIRAS DE CONTABILIDADE APLICADAS AO SETOR P\u00daBLICO – NBCASP, E POSS\u00cdVEIS ALTERA\u00c7\u00d5ES QUE OCORREREM POSTERIORES A CONTRATA\u00c7\u00c3O.<\/b><\/p>\n

 <\/p>\n

CL\u00c1USULA SEGUNDA \u2013 DA RETIFICA\u00c7\u00c3O<\/b><\/p>\n

2.1 \u2013 O presente Termo de Apostilamento objetiva a altera\u00e7\u00e3o do disposto na CL\u00c1USULA QUINTA \u2013 DA DOTA\u00c7\u00c3O OR\u00c7AMENT\u00c1RIA, prevista no instrumento contratual n\u00ba. 029\/2023, para fazer face ao acr\u00e9scimo de dota\u00e7\u00f5es or\u00e7ament\u00e1rias, conforme disp\u00f5e o artigo 65, par\u00e1grafo 8\u00ba, da Lei Federal n\u00ba. 8.666, de 21 de junho de 1993:<\/p>\n

 <\/p>\n

Art. 65. Os contratos regidos por esta Lei poder\u00e3o ser alterados, com as devidas justificativas, nos seguintes casos: (…) \u00a7 8\u00b0 A varia\u00e7\u00e3o do valor contratual para fazer face ao reajuste de pre\u00e7os previsto no pr\u00f3prio contrato, as atualiza\u00e7\u00f5es, compensa\u00e7\u00f5es ou penaliza\u00e7\u00f5es financeiras decorrentes das condi\u00e7\u00f5es de pagamento nele previstas, bem como o empenho de dota\u00e7\u00f5es or\u00e7ament\u00e1rias suplementares at\u00e9 o limite do seu valor corrigido, n\u00e3o caracterizam altera\u00e7\u00e3o do mesmo, podendo ser registrados por simples apostila, dispensando a celebra\u00e7\u00e3o de aditamento.<\/p>\n

4.1 \u2013 Ficam ratificadas as demais cl\u00e1usulas do contrato original, n\u00e3o alteradas pelo presente Termo de Apostilamento. E, por estarem assim justas e acertadas as partes, assina a CONTRATANTE o presente Termo de Apostilamento que doravante passa a fazer parte integrante do Contrato, para todos os fins legais e de direito.<\/p>\n
