TERMO DE RESCIS\u00c3O CONTRATUAL REFERENTE AO CONTRATO N\u00ba 057\/2022 QUE FAZEM ENTRE SI DE UM LADO O MUNIC\u00cdPIO DE LAJES\/RN E DE OUTRO LADO A EMPRESA\u00a0BIOMA SOLUCOES AMBIENTAIS LTDA<\/b>.<\/p>\n

A\u00a0PREFEITURA MUNICIPAL DE LAJES<\/b>, inscrita no CNPJ sob n\u00b0 08.113.466\/0001-05, com sede \u00e0 Rua Ramiro Pereira da Silva, 17, Centro \u2013 Lajes\/RN \u2013 CEP: 59535-000, neste ato representada pelo Sr. Prefeito Municipal\u00a0FELIPE FERREIRA DE MENEZES ARA\u00daJO<\/b>, (brasileiro), (casado) inscrito no CPF\/MF sob n\u00b0 090.085.724-27, doravante designado\u00a0CONTRATANTE<\/b>, e de outro lado\u00a0BIOMA SOLUCOES AMBIENTAIS LTDA<\/b>, com sede na Rua Nelson Geraldo Freire, 705, Apt 301 \u2013 Bloco B Condom\u00ednio Bellevue Garden, Candel\u00e1ria, Natal\/RN \u2013 CEP: 59.064-160, inscrita no CNPJ sob n\u00b0\u00a041.571.731\/0001-74<\/b>, neste ato, representada por\u00a0MARCELO DANTAS NEPOMUCENO<\/b>, inscrito no CPF sob o n\u00b0 466.548.104-06 e RG sob o n\u00ba 667660 \u2013 ITEP\/RN, resolvem, atrav\u00e9s do presente,\u00a0RESCINDIR BILATERALMENTE\/AMIG\u00c1VEL O CONTRATO ADMINISTRATIVO N\u00ba 057\/2022\u00a0<\/b>firmado com a empresa\u00a0BIOMA SOLUCOES AMBIENTAIS LTDA<\/b>,\u00a0<\/b>em conformidade com as disposi\u00e7\u00f5es da Lei 8.666\/93 e suas altera\u00e7\u00f5es posteriores, conforme a seguir estipulado:<\/p>\n

 <\/p>\n

O Prefeito do munic\u00edpio de LAJES, Estado do Rio Grande do Norte, no uso das suas atribui\u00e7\u00f5es legais conferidas pela Lei Org\u00e2nica do Munic\u00edpio;<\/p>\n

 <\/p>\n

Considerando a previs\u00e3o na cl\u00e1usula d\u00e9cima do termo de contrato n\u00ba 057\/2022, que prev\u00ea:<\/p>\n

\u201c10.1.2. Amigavelmente, nos termos do art. 79, inciso II, da Lei n\u00ba 8.666, de 1993.\u201c<\/b><\/p>\n

Considerando o art. 79 da Lei 8666\/93, que prev\u00ea:<\/p>\n

Art. 79. A rescis\u00e3o do contrato poder\u00e1 ser:<\/p>\n

II – amig\u00e1vel, por acordo entre as partes, reduzida a termo no processo da licita\u00e7\u00e3o, desde que haja conveni\u00eancia para a Administra\u00e7\u00e3o;<\/p>\n

RESOLVE:<\/b><\/p>\n

Art. 1\u00b0 – As partes acima qualificadas resolvem de comum acordo\u00a0RESCINDIR BILATERALMENTE\/AMIGAVELMENTE O CONTRATO N\u00ba 057\/2022<\/b>, vinculado ao Preg\u00e3o Presencial n\u00ba 017\/2022, para\u00a0CONTRATA\u00c7\u00c3O DE EMPRESA ESPECIALIZADA NA \u00c1REA DE CONSULTORIA AMBIENTAL PARA PRESTA\u00c7\u00c3O DOS SERVI\u00c7OS DE APOIO, PLANEJAMENTO, GERENCIAMENTO, CONSULTORIA E ASSESSORIA T\u00c9CNICA ESPECIALIZADA NAS A\u00c7\u00d5ES REFERENTES \u00c0 GEST\u00c3O DE RES\u00cdDUOS NO MUNIC\u00cdPIO DE LAJES, BEM COMO AS ATIVIDADES DE SUPORTE \u00c0 ASSOCIA\u00c7\u00c3O DE CATADORES DE MATERIAIS RECICL\u00c1VEIS DE LAJES, CONFORME TERMO DE REFER\u00caNCIA<\/b>.<\/p>\n

Art. 3\u00b0 – Verificada a conveni\u00eancia para a Contratante PREFEITURA MUNICIPAL DE LAJES\/RN, e a inexist\u00eancia de preju\u00edzo \u00e0s pessoas jur\u00eddicas da CONTRATANTE e da CONTRATADA, o presente termo amig\u00e1vel operar-se-\u00e1 na forma da Lei, sem majora\u00e7\u00e3o contratual ou \u00f4nus a este ente p\u00fablico, exceto o de a Contratante pagar \u00e0 Contratada o valor das Notas Fiscais j\u00e1 faturadas referentes aos servi\u00e7os prestados que se encontram a pagar.<\/p>\n

Art. 4\u00ba – As partes concordam que, a partir da data de assinatura deste Termo, n\u00e3o haver\u00e1 obriga\u00e7\u00e3o da Contratada na presta\u00e7\u00e3o dos servi\u00e7os do objeto do Contrato n\u00ba 057\/2022.<\/p>\n

Art. 5\u00b0 – Este procedimento tem como base legal o artigo 78, da Lei n\u00ba 8.666\/93.<\/p>\n

Art. 6\u00ba – A rescis\u00e3o passa a valer na data de sua assinatura.<\/p>\n

O Presente Termo de Rescis\u00e3o ser\u00e1 publicado na forma resumida, atrav\u00e9s de Extrato, em ve\u00edculo de divulga\u00e7\u00e3o do Munic\u00edpio.<\/p>\n
