PRIMEIRO TERMO DE APOSTILAMENTO DE ALTERA\u00c7\u00c3O NA DOTA\u00c7\u00c3O OR\u00c7AMENT\u00c1RIA CONCERNENTE AO CONTRATO ADMINISTRATIVO N\u00ba 057\/2022, ENTRE A PREFEITURA MUNICIPAL DE LAJES\/RN E A EMPRESA BIOMA SOLUCOES AMBIENTAIS LTDA.<\/p>\n

Pelo presente instrumento contratual onde de um lado O MUNIC\u00cdPIO DE LAJES\/RN, pessoa jur\u00eddica de direito p\u00fablico, com sede administrativa \u00e0 Rua Ramiro Pereira da Silva, n\u00ba 17, centro \u2013 CEP: 59.535-000, devidamente inscrita no CNPJ\/MF, sob o n\u00ba. 08.113.466\/0001-05, neste ato representado, na forma de sua Lei Org\u00e2nica, pelo Prefeito Municipal o Sr. FELIPE FERREIRA DE MENEZES ARA\u00daJO, brasileiro, residente \u00e0 Rua Vereador Mael Querino, n\u00ba 88 centro, Lajes\/RN \u2013 CEP: 59.535-000, portador do CPF n\u00ba 090.085.724-27 e RG n\u00ba 2842134 \u2013 SSP\/RN, de um lado e de outro, a empresa BIOMA SOLUCOES AMBIENTAIS LTDA, CNPJ n\u00ba 41.571.731\/0001-74, estabelecida \u00e0 Rua Nelson Geraldo Freire, 705, Apt 301 \u2013 Bloco B Condom\u00ednio Bellevue Garden, Candel\u00e1ria, Natal\/RN \u2013 CEP: 59.064-160, sendo representada pelo Senhor MARCELO DANTAS NEPOMUCENO, portador do CPF: 466.548.104-06 e RG n\u00ba 000667660 \u2013 ITEP\/RN, resolvem celebrar o Termo de APOSTILAMENTO do Contrato n\u00ba 057\/2022, que se reger\u00e1 pela legisla\u00e7\u00e3o pertinente, Lei Federal n\u00ba 8.666\/93, com as altera\u00e7\u00f5es introduzidas posteriormente e pelas cl\u00e1usulas e condi\u00e7\u00f5es seguintes:<\/p>\n

CL\u00c1USULA PRIMEIRA – DO OBJETO<\/b><\/p>\n

1.1 \u2013 Constitui objeto do presente termo de apostilamento contratual a altera\u00e7\u00e3o de dota\u00e7\u00e3o or\u00e7ament\u00e1ria que far\u00e1 frente \u00e0s despesas do contrato administrativo n\u00ba 057\/2022 origin\u00e1rio do processo de Preg\u00e3o Presencial 17\/2022, que versa sobre CONTRATA\u00c7\u00c3O DE EMPRESA ESPECIALIZADA NA \u00c1REA DE CONSULTORIA AMBIENTAL PARA PRESTA\u00c7\u00c3O DOS SERVI\u00c7OS DE APOIO, PLANEJAMENTO, GERENCIAMENTO, CONSULTORIA E ASSESSORIA T\u00c9CNICA ESPECIALIZADA NAS A\u00c7\u00d5ES REFERENTES \u00c0 GEST\u00c3O DE RES\u00cdDUOS NO MUNIC\u00cdPIO DE LAJES, BEM COMO AS ATIVIDADES DE SUPORTE \u00c0 ASSOCIA\u00c7\u00c3O DE CATADORES DE MATERIAIS RECICL\u00c1VEIS DE LAJES, CONFORME TERMO DE REFER\u00caNCIA.<\/p>\n

 <\/p>\n

CL\u00c1USULA SEGUNDA \u2013 DA RETIFICA\u00c7\u00c3O<\/p>\n

2.1 \u2013 O presente Termo de Apostilamento objetiva a altera\u00e7\u00e3o do disposto na CL\u00c1USULA TERCEIRA \u2013 DA DOTA\u00c7\u00c3O OR\u00c7AMENT\u00c1RIA, prevista no instrumento contratual n\u00ba 057\/2022, proveniente do processo de Preg\u00e3o Presencial N\u00ba 17\/2021, para fazer face a altera\u00e7\u00e3o de dota\u00e7\u00f5es or\u00e7ament\u00e1rias, conforme disp\u00f5e o artigo 65, par\u00e1grafo 8\u00ba, da Lei Federal n\u00ba. 8.666, de 21 de junho de 1993:<\/p>\n

 <\/p>\n

Art. 65. Os contratos regidos por esta Lei poder\u00e3o ser alterados, com as devidas justificativas, nos seguintes casos: (…) \u00a7 8\u00b0 A varia\u00e7\u00e3o do valor contratual para fazer face ao reajuste de pre\u00e7os previsto no pr\u00f3prio contrato, as atualiza\u00e7\u00f5es, compensa\u00e7\u00f5es ou penaliza\u00e7\u00f5es financeiras decorrentes das condi\u00e7\u00f5es de pagamento nele previstas, bem como o empenho de dota\u00e7\u00f5es or\u00e7ament\u00e1rias suplementares at\u00e9 o limite do seu valor corrigido, n\u00e3o caracterizam altera\u00e7\u00e3o do mesmo, podendo ser registrados por simples apostila, dispensando a celebra\u00e7\u00e3o de aditamento.<\/p>\n

CL\u00c1USULA TERCEIRA \u2013 DA PUBLICA\u00c7\u00c3O<\/p>\n

3.1 \u2013 Em virtude da altera\u00e7\u00e3o na dota\u00e7\u00e3o or\u00e7ament\u00e1ria objeto do presente termo, as despesas relativas ao Contrato Administrativo N\u00ba. 057\/2022, passar\u00e3o a ser consignadas na seguinte dota\u00e7\u00e3o or\u00e7ament\u00e1ria: Exerc\u00edcio 2023.<\/p>\n

CL\u00c1USULA QUARTA – DA RATIFICA\u00c7\u00c3O<\/p>\n

4.1 \u2013 Ficam ratificadas as demais cl\u00e1usulas do contrato original, n\u00e3o alteradas pelo presente Termo de Apostilamento. E, por estarem assim justas e acertadas as partes, assina a CONTRATANTE o presente Termo de Apostilamento que doravante passa a fazer parte integrante do Contrato, para todos os fins legais e de direito.<\/p>\n
